Terms and Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you”, “User”) and Gakkar Digital Services, operating the PicsForm platform (“PicsForm”, “we”, “us”, “our”).

By accessing PicsForm, creating an account, uploading or capturing a photograph, running compliance checks, or making a payment, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not upload photos, do not use AI processing, and do not purchase any plan.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use PicsForm and to accept these Terms.

If you upload a photo of another person (including a minor), you represent that you are the applicant, parent, legal guardian, or otherwise authorised to submit and process that person’s image for document-photo purposes, and that you have obtained all required consents.

You are solely responsible for ensuring your use complies with applicable laws in your country of residence and the country of the document application.

By uploading, capturing, or otherwise providing an image, and by checking the consent box on the upload step, you expressly grant PicsForm permission to process that image using PicsForm’s algorithms and third-party AI / machine-learning models and infrastructure.

Processing may include, without limitation: face and head detection; geometric crop and framing; background removal and replacement; exposure adjustment; appearance quality checks; optional glasses removal or portrait enhancement; watermarking of unpaid previews; generation of print sheets; and compliance scoring against document rules.

You understand that image processing may be performed on our servers and/or by subprocessors (including cloud AI providers such as fal.ai and similar vendors). Images and derived data may be transmitted to those providers solely to deliver the Service.

You retain ownership of your original photograph. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit, display (to you), and store the image and outputs as needed to operate PicsForm, fulfil your order, provide support, prevent fraud/abuse, and comply with law.

You warrant that you have all rights necessary to grant this licence and that the image does not infringe any third-party rights (privacy, publicity, copyright, or otherwise).

PicsForm provides tooling to help you create a photograph that matches published document-photo requirements (size, head height, background, and similar rules).

We do not provide legal, immigration, or eligibility advice. A Ready result means the photo matches the published photo specification we have on file — not that a visa, passport, or other application will be approved.

Compliance scores, Ready / Review / Retake, checklists, and Auto-improve results are informational aids only. We do not guarantee that any photograph will be accepted by any government authority, embassy, consulate, visa centre, passport office, airline, employer, or other third party.

Official rules change; automated checks may miss or misclassify issues (including glasses, headwear, lighting, expression, or crop). You remain solely responsible for verifying the final image against the official requirements of your document before submission.

Any rejection, delay, re-application fee, travel disruption, missed appointment, or consequential loss arising from use of a PicsForm output is your sole risk.

Paid plans (Digital and Print Ready) are one-time purchases for the deliverables described at checkout, unless we expressly state otherwise.

Payments are processed by Razorpay or other payment partners we designate. Your card/UPI/netbanking relationship is with the payment provider under their terms.

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE once successfully authorised, except where mandatory consumer law in your jurisdiction requires a refund. This includes cases where: you change your mind; you dislike the crop or AI result; a government later rejects the photo; Auto-improve does not remove glasses or other attributes to your satisfaction; you selected the wrong document or country; you failed to download files; or you lost access to your device or email.

If a technical fault on our side prevents delivery of a paid digital file that we can verify, contact support within seven (7) days of payment with your order ID. We may, at our sole discretion, re-provide the file, offer a credit, or issue a limited refund — without admitting liability.

Prices may change at any time for future purchases. Taxes, FX conversion, and payment-provider fees may apply.

Features differ by plan. Digital includes the official digital photo download. Print Ready adds print sheets and a photo-lab pack.

After payment, signed-in users receive a payment confirmation and professional invoice by email, and may re-download invoices from My photos.

You must download and safely store your files. We may retain vault copies for signed-in users for a limited period but are not obligated to retain files indefinitely.

Watermarked previews are for evaluation only and must not be submitted to authorities.

AI outputs can be imperfect. Face detection, glasses removal, upscaling, and appearance checks may fail or produce artefacts.

Where we describe “Face Integrity”, we mean we do not intentionally reshape the face, apply beauty filters, or perform identity-changing edits. Permitted processing is defined per ruleset. This is not a warranty that pixel values are unchanged or that biometric match scores with any system will be unchanged or improved.

You acknowledge that photographs of faces may constitute personal data and, in some jurisdictions, biometric-related data. You consent to such processing for the purpose of providing document-photo preparation services as described in the Privacy Policy.

Do not upload images you are not allowed to process, or images containing unlawful content.

You agree not to: misuse the Service; attempt to reverse engineer or overload systems; bypass paywalls or watermarks; use outputs to impersonate someone without authority; upload malware; scrape the Service; or use PicsForm for any unlawful purpose.

We may suspend or terminate access, delete content, or refuse service where we reasonably suspect abuse, fraud, or legal risk.

PicsForm software, branding, UI, copy, algorithms, and documentation are owned by Gakkar Digital Services or its licensors. You receive a limited, revocable, non-transferable right to use the Service as offered.

You may not copy, resell, or white-label the Service without prior written consent.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation, or that defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAKKAR DIGITAL SERVICES, ITS OWNERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, TRAVEL COSTS, VISA FEES, OR APPLICATION DELAYS, ARISING FROM OR RELATED TO YOUR USE OF PicsForm OR RELIANCE ON ANY OUTPUT.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE CLAIM (OR INR 1,000 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

You agree to defend, indemnify, and hold harmless Gakkar Digital Services and its affiliates, officers, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: your photos or content; your breach of these Terms; your violation of law or third-party rights; or your submission of PicsForm outputs to any authority.

Personal data is handled as described in our Privacy Policy. By using PicsForm you also acknowledge that policy.

We may modify the Service or these Terms at any time. Updated Terms will show a new effective date. Continued use after changes constitutes acceptance. Material changes may be communicated via the website or email when appropriate.

These Terms are governed by the laws of India, without regard to conflict-of-law rules.

Courts in India shall have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that cannot be waived.

Before filing a claim, you agree to attempt good-faith resolution by contacting support with a clear description of the issue and your order ID.

If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement regarding the Service and supersede prior understandings on the same subject.
